Okura Nikko Hotels Gift Check Terms of Use

Article 1 (Purpose of These Terms)

These Terms of Use (hereinafter referred to as “the Terms”) stipulate the use of the Okura Nikko Hotels Gift Check (hereinafter referred to as “Gift Check”) issued by Hotel Okura Co., Ltd. (hereinafter referred to as “the Company”). Each individual holder of a Gift Check (hereinafter referred to as “the Customer”) shall use it in accordance with these Terms.

Article 2 (Definitions)

The definitions of words and phrases used in these Terms are as follows, unless otherwise defined:

1. Gift Check

   (1) A prepaid payment instrument issued by the Company, which can be used to purchase or receive products or services at shops designated by the Company, based on the value stated on the voucher.

   (2) There shall be only one type of Gift Check, with a face value of JPY 5,000.

2. Gift Check Distributors

   (1) Distributors (hereinafter referred to as “Distributors”) authorized by the Company to sell the Gift Check.

   (2) The number of Distributors may vary.

3. Gift Check Dealers

   (1) Hotels in Japan under Okura Hotels & Resorts, Nikko Hotels International, and Hotel JAL City, as well as in-hotel shops and other restaurants located in Japan (hereinafter referred to as “Dealers”) that are authorized by the Company to handle Gift Checks.

   (2) The number of Dealers may vary.

4. Customer

   A person who has received a Gift Check from the Company or a Distributor (including a third party who has received it from the Distributors), understands, agrees, and accepts all the provisions of these Terms, and actually possesses and uses the Gift Check as per these Terms.

5. Products

   Products (excluding gift certificates, etc.) sold or services provided at Dealers are collectively referred to as “Products.

Article 3 (Use of the Gift Check)

1. Customers may only use Gift Checks at Dealers.

2. Gift Checks may not be used if they are torn along the perforation, damaged, or if the voucher number cannot be verified for any reason, or if more than one-third of the Gift Check is missing.

3. When purchasing a product with a Gift Check, the Customer must present it to the shop.

4. If the value of the Gift Check is less than the total purchase amount, the Customer must pay the difference in cash or by another payment method specified by the Dealer.

5. If the value of the Gift Check exceeds the total purchase amount, no change will be given.

Article 4 (Redemption and Refunds)

1. In principle, Gift Checks are non-redeemable and non-refundable.

2. Notwithstanding the above, if the Company decides to discontinue the issuance of the Gift Checks due to changes in social conditions, relevant laws, or other reasons, the Customer may request a refund from the Company. In this case, the refund will be processed according to the Company’s designated method.

3. In the case of a refund, the Company will collect the Gift Checks from the Customer.

Article 5 (Reissue)

Even if the Gift Check is lost, stolen, tampered with, or used by a third party without the Customer’s permission, please note that no refund or reissue will be made.

Article 6 (Fraudulent Acquisition or Use)

1. The Company, Distributors, and Dealers may refuse to accept the Gift Check in any of the following circumstances:

   (1) If the Customer has acquired the Gift Check by fraudulent means or is aware that it was fraudulently obtained and attempts to use it.

   (2) If the Gift Check is tampered with, forged, or altered.

   (3) If the Customer violates any of these Terms.

   (4) If the Company, Distributor, or Dealer determines that the use of the Gift Check is fraudulent.

2. In the case of the above, the Company, Distributors, and Dealers may temporarily hold the Gift Check for investigation.

3. The Customer shall not demand a refund, reissue, or exchange of the Gift Check in the above case.

Article 7 (Collection and Use of Personal Information)

1. The Company will not collect personal information from the Customer in the course of transactions under these Terms, except as required by law.

2. If the Customer provides personal information or Gift Check details to the Distributor or Dealer, it shall be done based on the agreement between the Customer and the respective shop.

Article 8 (Expiration Date)

The expiration date of the Gift Check is indefinite.

Article 9 (Outsourcing)

The Company may outsource operations related to the Gift Check to a third party.

Article 10 (Prohibition of Pledge or Other Security Interests)

1. The Customer may not pledge or grant any security interest on the Gift Check.

2. The Company, Distributors, and Dealers will not be involved in any disputes or be held responsible for any issues arising from such violations.

Article 11 (Amendment of Terms)

1. The Company may amend these Terms at its discretion without prior notice to the Customer.

2. If the Company changes the Terms, it will promptly post the updated Terms on its website for the specified period. After the period ends, the revised Terms will apply to all transactions.

Article 12 (Jurisdiction)

In the event of a dispute between the Customer and the Company, Distributors or Dealers arising from the use or transaction of the Gift Check related to these Terms, the Tokyo District Court or the Tokyo Summary Court will have exclusive jurisdiction.

Article 13 (Legal Guarantee)

1. The Company has entered into a guarantee contract with Aioi Nissay Dowa Insurance Co., Ltd. regarding the issuance guarantee of the Gift Check and has taken security measures to preserve the required deposit as stipulated in Article 14 of the Payment Services Act.

2. The Customer has the right to be paid in priority over other creditors for the issuance guarantee.

Supplementary Provisions

These Terms are effective from November 1, 2021.
